Please read these Terms of Use carefully before using the services provided by the website neurohirurgija.in.rs or contacting us for an online consultation or medical advice. By accessing this website and initiating communication for scheduling or obtaining medical services, you confirm that you have read, understood, and agreed to these Terms of Use.

1. Introduction and Acceptance of Terms

These Terms of Use („Terms“) govern the use of the website neurohirurgija.in.rs („Site“) and the online consultation services provided by Dr. Zeljko Kojadinovic („Service Provider“).

By using the Site, sending messages via Viber, WhatsApp, email, or otherwise contacting the Service Provider for the purpose of receiving medical advice or consultations, you accept these Terms and agree to comply with them. If you do not agree with any part of these Terms, please do not use our services.

2. Nature and Limitations of Services

Online consultations we provide are not a substitute for in-person medical examinations. The content available on this website is for educational purposes only and does not constitute medical advice, diagnosis, or treatment. Always consult a qualified physician for medical decisions.

Online consultations and advice: The Service Provider offers online medical consultations, second opinions, and guidance in the field of neurosurgery and chronic pain treatment. These services are provided based on the information submitted by the user (the patient).

These services are not a full substitute for physical examination: Online consultations are NOT a replacement for in-person examination, especially in cases requiring urgent medical care. Therefore, patients are expected to provide prior medical documentation that includes a report from at least one physical examination. The Service Provider is not liable for immediate health outcomes based solely on online consultations without physical examination data.

Limitations of Information: Medical advice given during online consultations is based solely on the information you provide (symptom descriptions, medical documents, test results). The accuracy and effectiveness of the consultation depend on the completeness and accuracy of this information.

Emergency situations: In the case of a medical emergency, seek immediate assistance from your local emergency services. Online consultations are not intended for emergencies.

3. Responsibilities of the Patient

By using our services, you agree to:

  • Provide accurate, complete, and truthful personal and medical information.
  • Understand the benefits and limitations of online consultations, and that such consultations may not suffice for a definitive diagnosis without additional in-person examinations.
  • Not use the services for any unlawful or prohibited activities.
  • Not misuse communication platforms (Viber, WhatsApp, email).
  • Seek proper medical help immediately if your condition worsens or new symptoms appear.

4. Communication and Appointment Scheduling

Communication for scheduling and consultations is conducted via Facebook Messenger WhatsApp, or email, as listed on the Site. Calls via these platforms are inactive unless otherwise agreed upon for a video consultation.

Appointments are scheduled through written messages. All information about the handling of personal data during communication is provided in our Privacy Policy.

5. Consultation on Behalf of a Patient

When explicitly authorized by the patient, a third party (e.g., family member or guardian) may request and conduct a consultation on their behalf.

If the patient is unable to give consent (e.g., due to coma, psychological condition, acute illness), a third party may request a consultation with the responsibility of having legal or justified grounds for doing so.

In both cases, the third party assumes responsibility for the accuracy and completeness of the data provided and for using the received information in the best interest of the patient.

The Service Provider is not liable for any misuse of information shared with a third party that is later used against the patient’s interest (e.g., sick leave denial, insurance disputes, etc.).

6. Payment Terms

The price of the online consultation and payment method will be communicated via the agreed platform (Facebook Messenger, WhatsApp, email) before the appointment is scheduled or consultation begins.

Consultations are scheduled and conducted only after the patient agrees to the proposed price and payment terms.

Cancellation and Rescheduling Policy: If the patient cannot attend the scheduled consultation, the appointment may be rescheduled if we are notified at least 5 hours in advance. After this deadline, rescheduling or refund is no longer possible, as the appointment has already been reserved and cannot be reassigned to another patient at such short notice. This policy respects the time and resources involved and is aligned with international medical practice. The cancellation and refund policy will be clearly communicated if a scheduled appointment is canceled.

7. Confidentiality and Data Protection

The Service Provider is committed to treating all personal and medical data received from users with the highest degree of confidentiality and in accordance with applicable data protection laws. Detailed information on the collection, processing, storage, and protection of your data is provided in our Privacy Policy. By sending a message and using our services, you agree to this policy.

8. Limitation of Liability

The Service Provider makes every professional effort to provide accurate and useful information during online consultations, but due to the nature of remote communication, informs users of the following:

  • The Service Provider is not liable for any damage, loss, or deterioration of health resulting directly or indirectly from the use of the Site or online consultations.
  • The Service Provider cannot guarantee that the information provided by the user during the consultation is complete, accurate, or sufficient to make a final diagnosis. Based on the available data, the physician will offer professional opinions and recommendations, without guaranteeing the desired therapeutic outcome.
  • The patient will be informed during the consultation of possible causes of symptoms, the need for further diagnostic procedures, treatment suggestions, and the risks of following or not following those recommendations. The decision to implement the advice is entirely the patient’s, alone or in consultation with their attending physician.
  • The Service Provider is not responsible for technical interruptions or communication problems beyond their control, including internet issues, failures in messaging platforms (WhatsApp, Facebook Messenger, etc.), and other technical obstacles.
  • The Service Provider is not liable for any consequences resulting from inaccurate, incomplete, or incorrect information provided by the user.
  • As is standard in traditional consultations, the Service Provider cannot guarantee that the data received during online consultations will be complete or sufficient to ensure success. The Service Provider also cannot guarantee that the consultation will lead to the desired outcome.
  • Patients are informed that further deterioration of their condition may occur after the consultation due to disease progression, medication side effects, insufficient data, or other factors. Each patient will receive a detailed explanation of the suspected cause of symptoms, further diagnostics or treatment suggestions, and associated risks. The patient will decide whether to follow these recommendations.

9. Intellectual Property

All content on the Site, including texts, images, videos, design, and logos, is the property of the Service Provider or used with permission from rights holders and is protected by copyright and related laws. Any unauthorized use, reproduction, or distribution of the Site’s content without explicit written consent is prohibited.

10. Changes to Terms

The Service Provider reserves the right to update or amend these Terms periodically. Any changes take effect immediately upon publication on this page, and the „Effective Date“ will be updated. We recommend reviewing this page regularly. Continued use of services after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Srpska. In the event of any dispute arising out of or in connection with these Terms, the parties shall attempt to resolve it amicably. If this is not possible, the dispute shall be settled before the competent court in Novi Grad, Republic of Srpska.
